Holmes Dyer has provided statutory planning advice and Government liaison advice, and has assisted in the negotiation of approvals for highly sensitive amendments to the proposed Golf Course Resort on the southern coast of Dudley Peninsula at Peninsula Bay, Kangaroo Island.
Our involvement included consideration of the implications of the Environment Protection and Biodiversity Conservation Act, the Coastal Protection Act, the Development Act, and the complexities of Government ownership of the coastal strip of land from the foreshore to the cliff tops.
Issues included the sensitive location of villas within a natural environment while optimising coastal views, the provision of a new entry road, power and water supply, water storage dam, stormwater and sewage infrastructure location, the maintaining and/or re-routing of the coastal walking trail, and the creation of opportunities for freehold residential allotments to underpin financial viability.
Designs for the resort have focused upon a light touch on the landscape, including the use of raised structural pier footings and raised boardwalks.
